The petitioner/wife seeks transfer of the proceedings initiated by the respondent/husband in HMOP No.117 of 2024 from the file of Principal Sub Court, Kallakurichi to the file of Subordinate Court, Neyveli to be tried along with HMOP No.104 of 2023, filed by the petitioner/wife, for dissolution of marriage, which is pending on the file of Sub Court, Neyveli. 3. Mrs.R.Poornima, learned counsel for the respondent/husband submits that the petitioner/wife is residing only in Panruti and not in Neyveli and in fact, the petitioner has received Notice in HMOP No.117 of 2024, filed by the respondent/husband, only at Panruti address. 4. Be that as it may, considering the fact that HMOP No.104 of 2023 is pending on the file of Sub Court, Neyveli and also in view of the fact that the petitioner/wife has to take care of a four year child, in the interest of the petitioner/wife, the proceedings are to be transferred to the file of Sub Court, Neyveli. 5. Accordingly, Tr.C.M.P.No.555 of 2025 is allowed and the proceedings in HMOP No.117 of 2024 is withdrawn from the file of Principal Subordinate 2/4 https://www.mhc.tn.gov.in/judis Tr.C.M.P.No.555 of 2025 Court, Kallakurichi and the same is transferred to Subordinate Court, Neyveli to be jointly tried along with HMOP No.104 of 2023, pending on the file of Sub Court, Neyveli. 6. The Sub Court, Neyveli shall not insist the physical presence of the respondent/husband on all hearing dates, except where it is absolutely necessary. No costs.
