Neutral Citation No. - 2025:AHC:93334 Court No. - 9 Case :- MATTERS UNDER ARTICLE 227 No. - 5753 of 2025 Petitioner :- Kanhaiya Lal (Since Deceased) And 7 Others Respondent :- Ghanshyam Singh (Since Deceased) And 14 Others Counsel for Petitioner :- Naveen Kumar Shukla,Preet Pal Singh Rathore Hon'ble Rohit Ranjan Agarwal,J. This is defendants' petition. The suit instituted by plaintiffs- respondents was decreed by judgment and decree dated
24.03.2025. Against the said judgment and decree, Civil Appeal No. 22 of 2025 was filed before the Court of District Judge, Ramabai Nagar (Kanpur Dehat). The appeal was admitted by order dated 22.04.2025 and the records of trial court was summoned. On the stay application 6C2, the Court had fixed 13.05.2025.
Learned counsel for petitioners submits that now the next fixed is in July, 2025. He further contends that the trial court had directed for handing over the property in question within three months. In case, the possession is not given, plaintiffs would approach the court for getting decree executed. Having heard learned counsel for petitioner, I find that no useful purpose would be served in keeping the matter pending or calling for counter affidavit or issuing notice to respondents, at this stage, as the stay application is pending consideration before District Judge. In view of said fact, the District Judge, Ramabai Nagar (Kanpur Dehat) is hereby requested to proceed with application Paper No. 6C2 pending in Civil Appeal No. 22 of 2025 and decide the same, strictly in accordance with law after hearing all the affected parties, preferably, within a period of one month, from the date of production of certified copy of this order. With the aforesaid observations, writ petition stands disposed of.
