The petitioner apprehends her arrest in a case registered for the offence punishable under Sections 406, 420 and 34 of the Indian Penal Code. 3. The prosecution case, in short, is that informant’s father-in-law, namely Laxmi Singh, executed a sale deed of land appertaining to Khata No. 246, Survey No. 95145, Area- 14.75 decs., in favour of informant on 20.12.2023 in which this petitioner and one Rajeev Kumar were identifiers. It is further alleged that on the same day, this petitioner fraudulently got executed land of informant measuring 77 decs. from informant. 4. As a matter of fact, petitioner is own Gotni (sister-in-law) of informant and has falsely been implicated in this case. The sale deed in question was executed by the informant in favour of this petitioner after due payment of consideration money and after following all the procedures of registration. The alleged sale deed was executed on 20.12.2023 whereas the present F.I.R. has been lodged after inordinate delay of about 6 months on 04.06.2024 and there is no plausible explanation for the same. Moreover, the dispute is with regard to sale and purchase of land which is purely civil in nature. Petitioner is a lady and claims clean antecedents. 5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner. 6. Considering the facts and circumstances of the case, nature of accusation, relationship between the parties, delay in lodging of the F.I.R. and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed. 7.
Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. Patna High Court CR. MISC. No.53220 of 2025(2) dt.18-08-2025 3/3 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Riga P.S.
