ORAL JUDGMENT

Heard Sri Amit, who represents Sri S.G.Kadadakatti
learned counsel on record for the appellant as well as Sri S.S.Joshi learned counsel for respondent No.2.
2. This appeal is the outcome of the award that is passed by the Additional Motor Accident Claims Tribunal, Hirekerur in MVC 193 of 2011 dated 30.01.2016. This is a claimant's appeal.
3. Arguing the matter, learned counsel for the appellant contends that the appeal is filed only on limited grounds. Learned counsel states that the compensation that is awarded by the Tribunal towards ‘pain and suffering’, towards ‘loss of income during the laid up period’ and towards ‘loss of amenities in life’ is on lower side. Learned counsel thereby seeks for enhancement in compensation.

Learned counsel for respondent No.2 states that the tribunal having considered the totality of the evidence

produced, awarded justifiable sum as compensation, but in the light of the submission that is made by learned counsel for the appellant, there may be a marginal enhancement.
5. It is not in dispute that for the injuries sustained, the appellant took treatment as inpatient for a long period of 33 days. The tribunal awarded a sum of Rs.10,000/- only under head ‘pain and suffering’, Rs.6,600/- only towards ‘loss of income during laid up period’ and Rs.10,000/- only towards ‘loss of amenities in life’. Having considered the fact that the appellant took extensive treatment as inpatient for the injuries sustained and that he is left with disability of 15% in respect of whole body, despite such treatment, this Court is of the view that the compensation that is granted by the tribunal is required to be enhanced by Rs.50,000/- globally including interest. Therefore the appeal is disposed of with the following:
ORDER (i) The appeal is allowed in part.

(ii) The compensation that is granted by the Additional Motor Accident Claims Tribunal, Hirekerur, through orders in MVC 193 and 2011 dated 30.01.2016 is enhanced by Rs.50,000/-. (iii) Respondent No.2 is directed to deposit the enhanced sum within a period of 8 weeks from the date of receipt of certified copy of this judgment. (iv) Failure on part of respondent No.2 to deposit the enhanced sum within the time granted, shall lead to payment of interest at the rate of 6% per annum on the enhanced sum from the date of petition till the date of deposit. (v) On deposit, the appellant is permitted to withdraw the entire amount.
