Heard Sri Daya Shankar Srivastava, learned counsel for the petitioner and learned Standing Counsel for the State. 2. By means of this petition filed under Article 226 of Constitution of India, the petitioner has prayed for a writ of mandamus to command the concerned respondent no.3 to consider the claim of the absorption of the petitioner as a regular Computer Operator-cum-Junior Assistant in the light of the provisions as contained under Rule 21(2)(A) of The Uttar Pradesh Financial Management and Budget Directorate Electronic Data Processing Subordinate Service Rules 2005. 3. It is submitted that the respondent-establishment are governed under the Rules where the petitioner is discharging duties on contract basis eversince 2007. It is also submitted that recommendation has also been made by the Engineer-in-Chief (Development) and Head of Department, Uttar Pradesh Public Works Department dated 28.04.2021 to the Chief Secretary but till date no decision has been taken. 4. Learned Standing Counsel submits that since the matter is engaging attention of the State Government, State Government may be directed to take final decision in the matter of claim of the petitioner for regular appointment/absorption in the regular cadre of Computer Operator/Data Entry Operator. 5. In view of the above, this petition stands disposed of with direction to the State Government to take a final decision in the matter of recommendation made by the Engineer-in-Chief and Head of Department, Uttar Pradesh Public Works Department dated 28.04.2021 within two months of production of certified copy of this order.
