Gautam, learned counsel appearing for the petitioner and also Mr. H. Kharmih, learned Addl.PP appearing for the respondents. By this application the petitioner has challenged the orders dated 24.01.2025 and 28.02.2025 passed by the learned Sessions Judge, Ri- Bhoi District, Nongpoh in Sessions Case No.10 of 2024 whereby NBWA 2025:MLHC:293 was issued against the petitioner. The learned counsel appearing for the petitioner submits that the petitioner was all along appearing before the Trial Court and there was no requirement of issuance of NBWA against him to compel his appearance. He further submits that the petitioner is ready to appear before the Trial Court on the next date fixed and prays that the NBWA issued against him may be kept in abeyance. Mr. H. Kharmih, learned Addl.PP submits that he will have no objection to the prayer made by the petitioner for keeping the NBWA in abeyance in the event the petitioner appears before the Trial Court on the next date fixed i.e. 17.04.2025. He, however, submits that if the petitioner fails to appear before the Trial Court on the next date fixed, the NBWA issued against him shall be allowed to be executed. On consideration of the submissions made by the parties, this criminal petition is disposed of with the direction to the petitioner to appear before the Trial Court on the next date fixed i.e. 17.04.2025 without fail. The NBWA issued against the petitioner by order dated 28.02.2025 of the Trial Court shall be kept in abeyance till 17.04.2025. It is made clear that in the event the petitioner fails to appear before the Trial Court as ordered above, the NBWA issued against him may be executed in terms of the orders of the Trial Court.
