Neutral Citation No. - 2025:AHC:106818 Court No. - 4 Case :- WRIT - A No. - 7888 of 2025 Petitioner :- Satish Chand Respondent :- State Of U.P. And 5 Others Hon'ble Ajit Kumar,J. Learned counsel for the petitioner submits that petitioner had appeared as a candidate in the Civil Police Direct Recruitment, 2023, however, he has not been communicated marks. However, he is entitled to be considered in the category of dependent of freedom fighter. Learned Standing Counsel has obtained instructions in the matter which is taken on record, copy whereof has been supplied to learned counsel for the petitioner. From the instructions it transpires that the petitioner's certificate for dependents of freedom fighter was not as per format required to be issued by the authority of State Government as the certificate of dependents of freedom fighter dated 10.06.2017 was issued by the District Magistrate, Delhi for the purpose of Public Service Commission, Delhi and this has been taken very clearly a ground to reject the candidature of the petitioner as sub-category of dependents of freedom fighter for horizontal reservation. As a consequence thereof petitioner has been taken as a candidate belonging to Scheduled Caste category and since he could not score marks matching with the last selected candidate of Scheduled Caste category, his candidature was rejected. Upon a pointed query being made, learned counsel for the petitioner could not dispute that he has submitted the certificate issued by District Magistrate, Delhi. In the considered view of the posts were advertised by the State of U.P., therefore, the format prescribed for the particular certificate required under the advertisement ought to have been signed by an authority under the State Government authority by it. Accordingly, I decline to grant any indulgence in the matter. Petition is held to be devoid of merits and is hereby dismissed.
