ORAL ORDER
(PER: THE HON'BLE MR. JUSTICE M.NAGAPRASANNA)
1. The petitioner is before this Court seeking the following prayer: A. Issue a writ of mandamus directing the respondents to consider the case of the petitioner for his appointment in the post of Attender by considering the representation dated 21.09.2017 the copy of which has been produced herewith and marked as Annexure-A.
B. Any other direction which this Hon’ble Court deems fit to grant in the facts and circumstances of the case may kindly be granted in favour of the petitioner by allowing this writ petitioner with the cost throughout in the ends of justice and equity. 2. The respondents though served long ago have remained unrepresented. Therefore, the counsel for the petitioner is heard and the matter is considered. 3. The petitioner was appointed as an attender in the year 2009 as Meti/Kayaka Bandu at Babruwada Grama Panchayath and is working since 2009. 4.
The learned counsel for the petitioner submits that the petitioner has not been paid salary that is equivalent to his post

or equivalent to the post held by others on equal pay for equal work basis. Therefore, he has submitted a representation to the respondent to consider payment of salary and other incidental benefits. The representation has not met consideration, though it is submitted on 21.09.2017. 5. In the light of the submission of the petitioner, I deem it appropriate to dispose the petition with a direction to the respondents to consider the representation of the petitioner and pass necessary orders in accordance with law, if not already considered. In the event it is considered, it is open to the petitioner to avail of such remedy as available in law. In the event it is not considered, the same shall be considered within 12 weeks from the date of receipt of the copy of the order and necessary orders be passed thereon. Ordered accordingly.
