JUSTICE HASMUKH D. SUTHAR Date : 16/06/2025 ORAL ORDER RULE. Learned APP waives service of notice of Rule for and on behalf of the respondent No.1 – State of Gujarat. Present petition is filed under Article 226 of the Constitution of India with a prayer to direct the respondent authority to initiate strict legal action against the responsible police officer. Perusing the report dated 22.11.2023 submitted by the learned Sessions Judge, Ahmedabad, it appears that Inquiry No.38/2023 in connection of the allegation of the petitioners has been initiated and thereafter process under Section 323 read with Section 114 of the Indian Penal Code, 1860 has been issued against the erring police officer on 29.11.2023 i.e. after filing of the present petition. In view of the above, present petition is disposed of. It is made clear that this Court has not gone into the merits of the case. Rule is discharged. (HASMUKH D. SUTHAR, J.)
