The present apaplication has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as ‘BNSS’), seeking grant of anticipatory bail in connection with FIR No. 324/2025, registered at Police Station Naraina, New Delhi, for the offences punishable under Sections 69 and 351(3) of Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as ‘BNS’),

Learned counsel for the Applicant submits that there is a property dispute between the Applicant’s father and his uncle, and that there are audio recordings of conversations between the complainant and the Applicant’s uncle, wherein they are allegedly planning to blackmail and extort money from the Applicant’s father.

have been made by the Applicant against the complainant alleging extortion, which are still pending for investigation, and no action has been taken on the complaints made by the Applicant. 5. Per contra, learned APP for the State submits that although the complainant is a divorced woman and initially declined to enter into any relationship with the Applicant, subsequently, when the Applicant assured her that he would marry her, the parties lived together for three months in a live- in relationship. However, subsequently, the Applicant refused to marry her. 6. Learned APP for the State further submits that during the course of investigation, the Applicant’s uncle also stated before the Investigating Officer (‘IO’) that discussions regarding the proposed marriage were underway between the two families. 7. This Court has heard learned counsel for the Applicant and learned APP for the State. 8. It appears that initially, the parties have lived together for three months in a live-in relationship, and thereafter, the relationship turned sour, resulting in the registration of the present FIR. 9. At this stage, the audio conversation between the Applicant’s uncle and the complainant also cannot be ignored by this Court. 10. Accordingly, in the event of arrest, the applicant shall be released on anticipatory bail on furnishing a personal bond in the sum of Rs. 25,000/- with two sureties of the like amount to the satisfaction of the concerned SHO/Investigating Officer, subject to the following conditions: i) The Applicant shall join the investigation as and when required and shall cooperate with the Investigating Officer. ii) The Applicant shall remain available on the mobile number(s) This is a digitally signed order. shared by him with the concerned SHO/Investigating Officer. iii) The Applicant shall not directly or indirectly make an attempt to influence the witnesses or tamper with the evidence in any manner.
iv) In case of change of residential address/contact details, the Applicant shall promptly inform the same to the concerned I.O./SHO. 11. The application is disposed of accordingly. Pending application(s), if any, also stand disposed of. 12. Needless to state, nothing stated hereinabove shall be construed as an expression of opinion on the merits of the case, and the observations made herein are confined to the consideration of the present bail application. 13.
