2 CGR, J W.P.No.9040 of 2025
ORDER:
The present writ petition is filed challenging the inaction of the 4th respondent in considering the 1st petitioner’s representations dated 25.11.2019 and 02.11.2023, seeking appointment on compassionate grounds. The said action is alleged to be illegal, arbitrary and violative of Articles 14, 19 and 21 of the Constitution of India.
2. Heard Sri L. Hazarathaiah, learned counsel for the petitioners; learned Assistant Government Pleader for Services-I, appearing for the 1st respondent; and Sri K. Ashok, learned Standing Counsel for APSPDCL, appearing for respondent Nos.2 to 4.
3. The case of the petitioners is that the 1st petitioner’s husband, namely Sri S. Vasu, who was working as a Lineman with the 4th respondent, has been missing since 02.06.2014. A report was lodged with the Kaligiri Police Station on 19.11.2019, and FIR No.123 of 2019 was registered on the same day. Upon investigation, the police submitted a final report on 16.12.2021, concluding that it is a case of missing person, and his whereabouts are still not known. Later, the petitioners were also issued a Family Member Certificate by the Tahsildar, Kaligiri, vide L.Dis.(A).88/2022, dated 21.03.2022.
3 CGR, J W.P.No.9040 of 2025
4. As Sri S. Vasu has been missing for more than seven years, the 1st petitioner submitted representations dated 25.11.2019 and 02.11.2023 to the 4th respondent, seeking compassionate appointment for petitioner Nos.2 and 3, who are her children. However, no orders have been passed by the respondents, promoting the petitioners to approach this Court by way of the present writ petition.
5. Learned Assistant Government Pleader for Services-I appearing for the 1st respondent, on the written instructions, submits that the respondent Corporation, upon conducting an enquiry, has found that the 1st petitioner’s husband has indeed been missing for a long time. However, as no proper proposals were submitted by the petitioners, the claim for compassionate appointment could not be processed. The entitlement of the petitioners may be considered upon submission of appropriate proposals.
6.
Learned counsel for the petitioners submits that the 1st petitioner, having already submitted representations, is willing to submit a detailed proposal afresh and prays that the same be considered in accordance with law.
4 CGR, J W.P.No.9040 of 2025
7. In view of the aforesaid submissions and with the consent of both learned counsel, the Writ Petition is disposed of, at the stage of admission, with the following directions:
1. The 1st petitioner is permitted to submit a fresh proposal to the 4th respondent within a period of two (2) weeks from the date of receipt of a copy of this order.
2. Upon receipt of the fresh proposal, the 4th respondent is
directed to consider the same, along with the earlier representations dated 25.11.2019 and 02.11.2023, and pass speaking orders in accordance with law, within a period of six (6) weeks thereafter.
8. There shall be no order as to costs.
As a sequel, miscellaneous petitions, pending if any, shall stand closed.
