Basically the petitioner has argued that because of lodging the First Information Report dated 15.3.2024, the petitioner was apprehending that the police might during investigation cause harm to him to the extent of even killing him. He submits that earlier the First Information Report was lodged under Section 363 and 366 IPC but to make it look grave Section 376 IPC and Section 3/4 POCSO Act were added. 2. This Court is of the view that if the petitioner in this matter is apprehending danger of some sort then, he may make a prayer before the Chief Judicial Magistrate, Prayagraj for his surrender there itself. 3.
