THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO:
i. ISSUE WRIT OF MANDAMUS OR ANY OTHER ORDER OR DIRECTION, DIRECTING THE RESPONDENTS NO. 3 AND 4 TO CONSIDER THE REPRESENTATION DATED: 07.03.2019 SUBMITTED BY THE PETITIONER AS PER ANNEXURE-B AND C AND FURTHER TO PASS APPROPRIATE ORDER TO PAY THE SALARY OF THE PETITIONER ON PAR WITH MINIMUM WAGES WHICH THE PETITIONER IS LEGALLY ENTITLED TO RECEIVE.
ii. ISSUE ANY OTHER APPROPRIATE WRIT OR ORDER OR DIRECTION WHICH DEEMS FIT TO GRANT BY THIS HON'BLE COURT UNDER THE FACTS AND CIRCUMSTANCES OF THE CASE IN THE INTEREST OF JUSTICE AND EQUITY.
THIS WRIT PETITION, COMING ON FOR PRELIMINARY HEARING IN B GROUP THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
ORAL ORDER (PER: THE HON'BLE MR. JUSTICE M.NAGAPRASANNA)
1. The petitioner is before the Court on a strange circumstance of the petitioner not being paid minimum wages.
2. Heard the learned counsel Sri. A.S. Patil appearing for the petitioner, learned HCGP Smt. Girija S. Hiremath for respondent Nos.1 to 3 and the learned counsel Sri. Bhushan B. Kulkarni appearing for respondent No.4.

Learned counsel for respondent No.4 submits that the Deputy Commissioner is the appointing authority. Therefore,

orders will have to be passed by respondent No.4-Deputy Commissioner.
4. In the light of the said submission, I deem it appropriate to dispose the petition directing respondent No.4 to pass necessary orders on the representation submitted by the petitioner with an outer limit of 12 weeks from the date of receipt of the copy of the order.
5. It is needless to observe that the State would not practice, grant of wages which is less than minimum wages, and drive the petitioner again to this Court on the same cause of action. The representation of the petitioner shall merit
consideration, if not already considered, and if considered the petitioner is at liberty to avail such remedy as available in law. Ordered accordingly.
