The case of the prosecution is that the petitioner on the false promise of marriage, had sexual intercourse with the de-facto complainant, a minor girl, thereby she became pregnant. Hence, the case. 3. The learned counsel for the petitioner submitted that the petitioner and the victim girl had a love affair and victim later became pregnant. When she went to the hospital for medical examination her pregnancy confirmed. Side) appearing for the respondent submitted that the petitioner is a married man having female child of 3 years old. The petitioner taking advantage of the victim girl’s loneliness, entered into the house and committed penetrative sexual assault on the victim not once but on several occasions, due to which, the victim became pregnant. Now she also delivered a baby.
