The challenge in this petition is made to the transfer order dated 21.04.2025, issued by the respondent no.3, Prabhan Prabandhak Dugdh Utpadak Sahkari Sangh Limited, Anchal Dairy, by which the petitioner has been transferred from Dehradun to Lakhamandal. Learned counsel for the petitioner would submit that the petitioner has been transferred at a place where there is no position of Lab Technician, a post on which the petitioner is working. After arguing for a while, learned counsel for the petitioner would submit that the petitioner may be given liberty to file a fresh representation with the direction to the respondent no. 3 to decide it within a stipulate stipulated time. Learned counsel for the respondent no.3 would submit that, in fact, at Lakhamandal, where the petitioner has been transferred, there is a post on which the petitioner is appointed. Learned counsel for the respondent no.3 would submit that in case the petitioner gives a representation, it shall be decided within a period of three weeks. The Court takes on record the statement given by learned counsel for the respondent no.3. The writ petition is disposed of with the liberty to the petitioner to make a representation to the respondent nos. 3. The respondent no. 3 is further directed to take a decision on such representation within a period of three weeks. This Court makes it clear that by this order, the impugned transfer order has not been stayed. (Ravindra Maithani J.) 15.05.2025 RV
