IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No.12591 of 2024 Abhimanyu Padhiari … Petitioner None -versus- State of Odisha … Opposite Party Mr. R.B. Mishra, Addl. PP CORAM: JUSTICE G. SATAPATHY Order No. ORDER(ORAL) 15.05.2025 02. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. None appears for the Petitioner at the time of call, but it appears from the report submitted by the learned Addl. District Judge-cum-Special Court under POCSO Act, Cuttack vide letter no.55 dated 13.01.2025 that out of 22 charge-sheeted witnesses, 14 have already been examined and rest 8 witnesses have been declined and the case then was posted to 20.01.2025 for cross-examination of I.O. In such situation, this Court believes that the trial in this case would have been completed. 3. In view of the above facts, especially when there is no one to prosecute the bail application of the petitioner, the present bail application stands dismissed for non- prosecution. The petitioner is, however, at liberty to revive this application, if the cause of action still survives for him. (G. Satapathy) Judge Jayakrushna
