Heard learned counsel for the petitioner and learned counsel for the opposite party/husband. 2. The present transfer petition has been filed under Section 24 of the Code of Civil Procedure for transfer of Matrimonial (Divorce) Case No.107 of 2023 from the Court of Principal Judge, Family Court, Godda, to the Court of Principal Judge, Family Court, Dumka. 3. It has been submitted by the learned counsel for the petitioner that the parties are related by marriage which has taken place on 05.03.2017 as per Hindu Rites and Custom and they have blessed with one son and one daughter. Thus, the petitioner has to take care of her minor children. Further, the present divorce petition has been filed by the husband before the Family Court, Godda but the wife wants to transfer the same before the Family Court, Dumka where she resides. Further, the matrimonial dispute has arisen and maintenance case has been filed before the Family Court, Dumka. There is also criminal case. 4. Learned counsel for the opposite party has opposed the prayer of the petitiner by filing counter affidavit. 5. Considering the fact that the wife has to take care of her minor children, the Matrimonial (Divorce) Case No.107 of 2023, is hereby, transferred to the Court of Principal Judge, Family Court, Dumka. 6.
