Neutral Citation No. - 2025:AHC:111213 Court No. - 50 Case :- WRIT - B No. - 2373 of 2025 Petitioner :- Aman Tyagi Respondent :- Deputy Director Of Consolidation And 3 Others Counsel for Petitioner :- Ayyaz Khan,Vivek Kumar Shukla Counsel for Respondent :- C.S.C.,Ruduvant Pratap Singh Hon'ble Ajay Bhanot,J. Heard Shri Ayyaz Khan, learned counsel for the petitioner and Shri Jitendra Singh, learned counsel and Shri Deepak Singh, learned counsel for the respondents. While allowing the restoration application filed by the respondent no. 4 by order dated 19.12.2024 the Settlement Officer Consolidation has found that adequate opportunity was not given to the respondents prior to passing the order dated 23.08.2018. The order passed by the Settlement Officer Consolidation was taken in revision by the petitioner which has been dismissed as not maintainable by order dated 26.04.2025. The procedural fairness and compliance of natural justice lies at the heart of all adjudicatory processes. Admittedly the process adopted by the Settlement Officer Consolidation while passing the order dated 23.08.2018 was not known to law and was inconsistent with the principles of natural justice. There is no infirmity in the
order impugned in the writ petition. The Court declines to
interfere in the same. However, in view of the long pendency of the matter a direction is issued to the Settlement Officer Consolidation to decide the appeal by a reasoned order within a period of two months from the date of receipt of a certified copy of this order after hearing both the parties. All parties are
directed to cooperate in the aforesaid proceedings. The writ petition is disposed of.
