Ajay Mohan Goel, Judge (Oral) By way of this petition, the petitioners have prayed for the following reliefs:- “It is, therefore, most respectfully prayed that the present petition may kindly be allowed and order/judgment dated 25.04.2022 passed by the Ld. Civil judge, Court No. (8) in CMA NO. 509/2020 in Civil Suit No. 43/2020 titled as Sanjeev Sood Versus M C Shimla and Anr. and order /judgement dated 14.10.2022 passed by the Ld. District Judge, Shimla in the case of MC Shimla Versus Sanjeev Sharma in appeal No. 18- S/14 of 2022, may kindly be quashed and set aside, in the interest of justice and fair play.” 2. Having heard learned Counsel for the parties, though this Court is not interfering with the orders under challenge, but in 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2025:HHC:32499 the facts involved in the case, it is directed that an endeavour be made by learned Trial Court to decide the civil suit as expeditiously as possible. The case is stated to be at the stage of recording the evidence of the defendants. It is directed that it be ensured that not more than three opportunities shall be granted to the defendants to lead evidence and thereafter, the suit be decided by the learned Trial Court as expeditiously as possible. It is further clarified that in the course of adjudication of the civil suit, learned Trial Court shall not be influenced by any of the observations which have been made by either learned Trial court or the learned Appellate Court in the orders under challenge.
