The Court made the following order:
Both the accused in Crime No.280 of 2024 of Bommuru Police Station, East Godavari District, filed the present criminal petition seeking pre-arrest bail. The said crime was registered for the offences under Sections 7-B read with 8-A of the A.P.Prohibition (Amendment) Act, 2000. 2. The case of the prosecution is that on reliable information, Sub- Inspector of Police, Bommuru Police Station, along with mediators went to Ladies Colony situated at Kavalagoyyi Village, Rajamahendravaram Rural Mandal on 30.07.2024 at about 5.00 p.m. and found 400 liters of Illicitly Distilled arrack and 6000 liters F.J.Wash. 2 On seeing the police and mediators, the accused escaped from the scene. The police destroyed the entire arrack and F.J.Wash under panchanama after taking samples. After due enquiry, they came to know that the petitioners are manufacturing the illicitly distilled arrack in the said placed. On the basis of the said allegations, the said crime has been registered against the petitioners. 3. Learned counsel for the petitioners contends that the petitioners were not present at the scene of offence and the police foisted a false case against them due to statistical purpose. 4. On the other hand, learned Assistant Public Prosecutor opposed to grant anticipatory bail and contended that the contraband involved in the present crime is huge, which is 400 liters of illicitly distilled arrack and 6000 liters of F.J.Wash. The total value of the arrack and F.J.Wash is Rs.1,20,000/-. The police also seized the samples of arrack and F.J.Wash. 5. This Court perused the entire material on record. As seen from the panchanama, huge quantity of illicitly distilled arrack and F.J.Wash involved in the present crime and as such, this Court is not inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the Criminal Petition is dismissed. However, the petitioners are at liberty to surrender before the concerned Court and move an application for regular bail.
Upon filing such application, the
3 concerned Court is directed to dispose of the same on its merits, within one week thereafter. As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed. _________________________ JUSTICE K. SURESH REDDY Date : 28.03.2025
