Mr. M.K. Mohanty, ASC
CORAM:
MR. JUSTICE R.K. PATTANAIK
Order No.
ORDER 14.05.2026
04.
1. Heard learned counsel for the petitioners and State.
2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Loisinga P.S. Case No.261 of 2025 corresponding to G.R. Case No.416 of 2025 pending in the file of learned J.M.F.C. Loisinga on the grounds stated.
3. Perused the FIRs as at Annexures-1 and 2. Mr. Sahu,
learned counsel for the petitioners produced the statements of the witnesses recorded under Section 180 BNSS for the Court’s perusal in respect of Loisinga P.S. Case No.260 of 2025 registered later to the lodging of the FIR i.e. Annexure-2 from the side of the petitioners. Recorded the submission of Mr. Mohanty, learned ASC for the State with reference to the FIR. A copy of the injury report in respect of one of the victims of assault is at Annexure-3 but it does not reveal any external injury to have been sustained by the victim. The case diary is produced and the same is also gone through. An offence under p. 2 Section 118(2) BNSS has been registered but referring to an intimation received from the IIC of the concerned PS, it is submitted by Mr. Mohanty, ASC that the injury reports of the victims could not be collected despite several attempts by the IO. A copy of the letter dated 11th March, 2026 of the PS concerned is submitted to the Court along with the case diary. In view of the above and since there is nothing on record to show any grievous injury to have been received by the victims in absence of medical reports being furnished by them as claimed by the IO concerned, this Court, though not in favour of entertaining their bail plea but is inclined to direct all of them to surrender before the learned court below for being released with conditions.
4. Accordingly, it is ordered.
5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioners surrender before the court of learned J.M.F.C. Loisinga in connection with G.R. Case No.416 of 2025 corresponding to Loisinga P.S. Case No.261 of 2025 within a fortnight from today, they shall be released on bail upon furnishing a bail bond of Rs.20,000/-(rupees twenty thousand) each with one solvent surety for the like amount each with such other conditions imposed as deemed just and proper in the facts and circumstances of the case.
6. Issue urgent certified copy of this order as per rules.
