Learned counsel for the petitioner/wife submits that the petitioner is having permanent residence at Coimbatore and as on date, she is living with two children and she finds it difficult to travel from Coimbatore to Theni to attend the proceedings. 3. Notice was issued to the respondent, but none appeared for the respondent. 4. The fact reveals that the respondent/husband has filed HMOP No.364 of 2023 for restitution of conjugal rights and the petitioner/wife is not cooperating for mediation proceedings. Therefore, I do not find any reason to transfer the case from the file of Family Court, Theni to Family Court, Coimbatore. 5. Accordingly, the petition is dismissed and the matter is referred to Mediation and Conciliation Centre, Theni. Parties are directed to appear before the Mediation and Conciliation Centre, Theni District along with their respective counsel on 2/4 https://www.mhc.tn.gov.in/judis TR CMP No. 973 of 2025 23.06.2026. 6. The mediator shall conclude the proceedings within a period of three months from the date of receipt of a copy of this order. 7. The Family Court, Theni is directed to send the entire records relating to HMOP No.364 of 2023 to the Mediation and Conciliation Centre, Theni forthwith. 8. No costs.
