Neutral Citation No. - 2025:AHC:121496-DB Court No. - 39 Case :- WRIT - C No. - 17776 of 2025 Petitioner :- Rajendra Sharma @ Rajendra Pandit Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Anupam Kumar Shukla,Tanisha Jahangir Monir,V.R. Tiwari Counsel for Respondent :- C.S.C. Hon'ble Arindam Sinha,J. Hon'ble Dr. Yogendra Kumar Srivastava,J.
1. Heard Shri V.R. Tiwari, learned counsel for the petitioner and Shri Sharad Chandra Upadhyay, learned Standing Counsel appearing for the State-respondents.
2. The present petition has been filed seeking to challenge an order dated 30.01.2025 in terms of which, the representation dated 07.01.2025 submitted by the petitioner for grant of security was examined by the "Commissionerate Level Security Committee" at its meeting held on 30.01.2025 and the committee took a view that the petitioner's request for being granted security as a witness in a criminal case ought to be examined under the witness protection scheme-2018 by the District level committee, set up for the purpose. It was observed that the Commissionerate level committee did not perceive any serious threat to the petitioner for grant of security cover. The petitioner has accordingly been
directed to submit his representation under the witness protection scheme-2018 before the committee constituted at the district level for the purpose.
3. Counsel for the petitioner submits that he has already approached the District Judge, who is the Chairman of the
committee constituted under the witness protection scheme by submitting a representation dated 03.02.2025. He prays that the aforesaid representation may be accorded consideration.
4. Learned counsel appearing for the State-respondents submits that a report has already been forwarded by the police authorities for consideration of the representation of the petitioner for security under the witness protection scheme-2018.
5. Having regard to the aforesaid, the writ petition is disposed of with a direction to respondent no.6 to accord consideration to the representation submitted by the petitioner for security under the witness protection scheme and to pass an appropriate order within a period of four weeks from the date of communication of this
order by petitioner. It is made clear that the committee, which is to examine the case of the petitioner for grant of security under the witness protection scheme-2018, would not be influenced in any manner by what has been stated in the order impugned.
