Neutral Citation No. - 2025:AHC:113611 Court No. - 83 Case :- APPLICATION U/S 529 BNSS No. - 1784 of 2025 Applicant :- Subhash Kumar Opposite Party :- State of U.P. and Another Counsel for Applicant :- Abhishek Kumar Shukla,Amit Shukla,Dinesh Kumar Tiwari Counsel for Opposite Party :- G.A. Hon'ble Nalin Kumar Srivastava,J. 1. This application under Section 529 BNSS has been filed with a prayer to direct the court concerned to decide the Case No. 151 of 2025 arising out of case crime no. 570 of 2024, under Sections 420, 406, 506 IPC Police Station- Bita-2, District- Greater Noida (Commissionerate Gautam Buddha Nagar) pending in the Court of learned Additional Chief Judicial Magistrate-II, Gautam Buddh Nagar expeditiously within stipulated period. 2. Heard learned counsel for the applicant as well as learned A.G.A. for the State. 3. It is submitted by the learned counsel for the applicant that the applicant is the complainant in the said case. It is further submitted that charge sheet in this matter has been filed and the accused has been summoned. The Court concerned is not taking proper interest in disposal of the said case. 4. Learned AGA opposed the prayer. 5. I have considered the submissions and perused the record. 6. It appears from perusal of the record that charge sheet in this matter was filed just on 23.1.2025 and summoning order was passed fixing 30.5.2025. The matter is new and fresh and considering the heavy work load in the Magistrate Courts, I do not think it is a matter where direction for expeditious disposal should be passed to the trial Court. It really appears to be a premature application. No order for expeditious disposal is required at this stage. 8. Disposed of accordingly. Order Date :- 15.7.2025//Fhd Digitally signed by :- FAHAD NIYAZ High Court of Judicature at Allahabad
