C.R.P.No.2256 of 2025 O R D E R This Civil Revision Petition has been filed to direct the learned Principal Subordinate Judge, Tiruvannamalai, to dispose of E.P.No.161 of 2016 in L.A.O.P.No.2 of 2009 within a time frame fixed by this Court. 2.The petitioners' lands measuring 0.2546 sq.m. in S.F.No.78/1B were acquired by the Government vide Notification No.310, dated 12.10.2007 for the purpose of laying Tiruvannamalai By-Pass Road under the Tamil Nadu Highways Act. It appears that an Award has been passed on 31.03.2008 granting a total compensation of Rs.22,484/-. Thereafter, the Award was referred to the Reference Court for enhancement of compensation. The matter was taken on file by the learned Principal Subordinate Judge, Tiruvannamalai, in L.A.O.P.No.2 of 2009 on
01.10.2009. The Reference Court, by judgment and decree dated 04.03.2016, ordered enhancement of compensation. Thereafter, the matter was taken on appeal before this Court and this Court enhanced the compensation by order dated 21.11.2022. In the meanwhile, the petitioners have filed Execution Petition in E.P.No.161 of 2016 to realise the award amount as per the award of the Reference Court. Though the respondents https://www.mhc.tn.gov.in/judis
C.R.P.No.2256 of 2025 have made part payments during the pendency of proceedings before this Court, it appears that there is a balance of Rs.31,22,835/- calculated as on 20.08.2024 to be paid by the respondents along with interest. 3.It is the grievance of the petitioners that, though the lands were acquired on 12.10.2007, even after lapse of 18 years, the petitioners are not able to realise the entire award amount to which they are entitled.
It is the contention of the learned counsel for the petitioners that the Execution Petition is pending since 2016 and the matter is being adjourned for almost 26 hearings. Hence, the learned counsel prays for speedy disposal of the Execution Petition. 4.Considering the fact that the Execution Petition is pending since 2016 and the petitioners are unable to taste the fruits of success in the litigation for almost 18 years, and also taking note of the A-Diary Extract in E.P.No.161 of 2016 enclosed in the typed set of papers, this Court is inclined to issue a direction for speedy disposal of the Execution Petition.
