Heard Shri Dheeraj Kumar Dwivedi, learned counsel for the petitioner, Shri Rahul Asthana, learned AGA for the State- respondents and perused the records. 2. In pith and substance, the petitioner is seeking direction to respondents no. 1 to 3 to ensure fair, impartial and proper investigation in respect of first information report dated 21.09.2024, registered as Case Crime No.615 of 2024, under Section 420, 467, 468, 471, 395, 386 IPC, Police Station Chakeri, District Purvi Commissionerate Kanpur Nagar. 3. Learned counsel for the petitioner then submitted that he has already filed an application for this purpose before the Commissioner of Police, Kanpur Nagar on 19.12.2024 and the same has not been decided as yet. Although, comments were called for by the Commissioner of Police, Kanpur Nagar. We find that the petitioner has already availed appropriate remedy, therefore, no fruitful purpose would be served by keeping the matter pending. 4. Accordingly, present writ petition stands disposed of with a direction to the respondent no.2, Police Commissioner, Purvi Commissionerate, Kanpur Nagar to consider and decide the application of the petitioner dated 19.12.2024 on its own merits in accordance with law, expeditiously, preferably within a period of six weeks from the date of receipt of certified copy of this order. 5.
