By means of this petition filed under Article 226 of the Constitution, petitioner has prayed for following substantial relief: "i) Issue a writ, order or direction in the nature of mandamus directing the respondents concerned to grant benefits of old pension scheme to the petitioner by considering his regularization with effect from 20.12.2001 within some stipulated period as may be fixed by this Hon'ble Court." Learned counsel for the petitioner has relied upon the Division Bench judgment of this Court passed in the case of State of U.P. and others v. Chandra Mohan Yadav Retired Junior Engineer Civil Nagar NIgam Allahabad Prayagraj passed in Special Appeal No.- 607 of 2024 and other connected matters decided on 6th May, 2025. Learned Standing counsel has no objection in case if petitioner's representation is directed to be decided by the concerned competent respondent in a time bound period and in accordance with law, provided petitioner makes a fresh representation. In view of the above, this petition stands disposed of with a direction to the petitioner to make fresh representation before the respondent concerned within a period of four weeks from today and in the event such representation is made as directed herein above, the same shall be considered and decided in the light of the aforesaid Division Bench judgment of this Court as expeditiously as possible preferably within a further period of two months. Needless to add, the order to be passed by the respondent concerned as directed herein above, shall be reasoned and speaking one.
