This writ petition has been filed with the following prayer: "1. A writ order or direction in the nature of Mandamus directing the Court concern i.e. Up-Zila Adhikari Tehsil Sadar, District Varanasi (Respondent No.2) to decide the Appeal No: 29500/2024 (Computerized Case No: T202414700129500) Le., Akshyabar Prasad Vs. Pawan Kumar Yadav and Others, Under Section 35(2) of Uttar Pradesh Revenue Code, 2006, within some stipulated period in the interest of justice, within some stipulated period in the interest of justice." It is contended that Appeal No.29500 of 2024 (Computerized No.T202414700129500) filed under section- 35(2) of U.P. Revenue Code 2006 is pending consideration before respondent no.2- Up-Zila Adhikari Tehsil Sadar, District Varanasi. The sole prayer made in the writ petition is to expeditiously decide the said appeal. As no useful purpose would be served in keeping the matter pending or issuing notice to the private respondents, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit, with a direction upon respondent no.2- Up-Zila Adhikari Tehsil Sadar, District Varanasi to decide Appeal No.29500 of 2024 (Computerized No.T202414700129500), under Section- 35 (2) U.P. Revenue Code 2006, in accordance with law, after hearing all affected parties, preferably within a period of three months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
