THIS WRIT PETITION, COMING ON FOR PRELIMINARY HEARING THIS DAY, ORDER WAS MADE THEREIN AS UNDER: Digitally signed by GIRIJA A. BYAHATTI Location: High Court of Karnataka, Dharwad Bench, Dharwad - 2 - HC-KAR NC: 2025:KHC-D:10964 WP No. 103731 of 2025 ORAL ORDER (PER: THE HON'BLE MR. JUSTICE SURAJ GOVINDARAJ) 1. The petitioner is before this Court seeking for the following reliefs: a. Issue a writ in the nature of mandamus directing the R2 to consider the representations dated 13.12.2023 & 4.12.2024 produced and marked as Annexures E & F, respectively. b. To pass any other order, direction as deemed fit in the circumstances of the case. 2. A short grievance of the petitioner is that the request made by the petitioner for selling the plot allotted by respondent No.2 to the petitioner has not been considered. As such, the representations having been submitted on 13.12.2023 & 4.12.2024 at Annexure-E and F have not been considered. The reason for such request being that the petitioner has stopped running his business and as of now, the ginning factory is in dilapidated condition. It is in that background that the petitioner is before this Court seeking for the aforesaid reliefs. - 3 - HC-KAR NC: 2025:KHC-D:10964 WP No. 103731 of 2025 3. Whenever any representation has been submitted by a citizen to any Authority, it is required that the said representation to be acted upon and necessary orders to be passed, either accepting or rejecting the representation submitted in accordance with law. 4. Needless to say, if an order of rejection is passed, the same would have to be accompanied by reasons. Neither having been done, I pass the following: ORDER i. The writ petition is allowed. ii. A mandamus is issued, directing respondent No.2 to consider the representations of the petitioner dated 13.12.2023 & 4.12.2024 at Annexure-E and F and pass necessary orders within a period of eight weeks from the date of receipt of copy of this order.
