As competing claims in respect of compassionate appointment were put forth before the authorities and such claims were not adverted to, nor the dispute on merits was otherwise examined by the competent authority, as such learned Single Judge has remitted the matter back to the authority concerned to pass a fresh order in respect of grant of compassionate appointment after affording an opportunity of hearing to the parties. Considering the nature of order passed by the learned Single Judge, we are not persuaded to interfere in the matter as the facts asserted by the parties require appropriate consideration at the level of the authorities. In order to facilitate such fresh consideration, we direct the parties to appear before the District Basic Education Officer, Azamgarh, alongwith a copy of this order on 09.06.2025 who shall examine the records and pass appropriate orders within a period of two months.
