Order 20/08/2025
1. Heard learned counsel for the appellant.
2. This appeal has been filed by the appellant challenging the
order dated 07.01.2025 passed by the learned Single Judge of this Court.
[2025:RJ-JP:32647-DB] (2 of 2) [SAW-426/2025]
2. Matter relates to appointment on the post of Investigation Assistant in pursuance to the advertisement issued in the year
2009.
3. The contention of learned counsel for the appellant is that the appellant-petitioner has applied for the said post through proper channel. However, before the learned Single Judge, the recruiting agency has filed reply stating therein that they have not received any application submitted by the appellant-petitioner.
4. We have gone through the record.
5. Admittedly, the recruitment in question relates to the year 2009 and the selection on the said post has already been over. After passing of 15 years, we are not inclined to disturb the settled position in the department with regard to the employees working on the said post.
6. We have also considered the fact that there is a disputed question of fact as to whether the application was submitted by the petitioner within time or the same was forwarded by his parent department to the recruiting agency within time.
7. Therefore, we are not inclined to interfere in the judgment dated 07.01.2025 passed by the learned Single Judge. Hence, this appeal is dismissed.
