Neutral Citation No. - 2025:AHC:91468 Court No. - 77 Case :- TRANSFER APPLICATION (CRIMINAL) No. - 259 of 2025 Applicant :- Vinod Kumar Opposite Party :- State Of U.P. And 4 Others Counsel for Applicant :- Deepak Rana Counsel for Opposite Party :- G.A. Hon'ble Manoj Bajaj,J. Applicant has filed this application under Section 447 of Bhartiya Nagarik Suraksha Sanhita, 2023 for transfer of Session Trial No.372 of 2021; titled : State Vs. Surendra @ Chidiya and others, arising out of Case Crime No.111 of 2021, Under Sections 302, 120-B I.P.C., Police Station- Loni, District- Ghaziabad pending in the Court of Additional Sessions Judge, Court No.1, Ghaziabad to any other competent Court of jurisdiction at Ghaziabad.
Learned counsel for the applicant has argued that the subject trial relates to the murder of complainant's father and one of the accused persons namely Trilok Chandra Bhati is son-in-law of the deceased. He submits that the accused have proclaimed that they are likely to be acquitted in the case, therefore, an application was moved before the Sessions Judge, Ghaziabad for transfer of the trial, but the same was dismissed vide order dated 19.5.2025. He prays that the pending trial be transferred to some other Court of competent jurisdiction. During the course of hearing, it is not disputed that the prosecution evidence stands concluded and the trial is at the last stage. Upon hearing the learned counsel for the parties and considering their submissions, this Court does not find any merit in the application as the sole ground raised for transfer of the case is not supported with any convincing material. Thus, no ground is made out for transfer of the case. The application is dismissed.
