WP (C ) 354/2025 M/S ABDUL AHAD RESHI …Petitioner(s)/Appellant(s)
Through: Mr. F.A. Wani, Advocate
Vs.
UT OF J AND K AND ORS. ...Respondent(s) Through: Mr. Furqan Yaqub Sofi, GA
CORAM: HON’BLE MR. JUSTICE RAHUL BHARTI, JUDGE
ORDER 25-02-2025
1. From a bare reading of the writ petition it is evident that the writ petitioner has come up with the present writ petition with a non-serious mindset by generating a two page writ petition without any iota of factual detail stated therein as if this court is to act as an accountant of the petitioner to peruse the annexures to figure out and make out as to how much money is actually payable to the petitioner from the end of the respondents relatable to a cause of action of 2015.
2. When pointed out as to the patent deficiency of pleading to the full upon which writ jurisdiction under article 226 of the Constitution of India can be called upon to be exercised, the learned counsel for
the petitioner admits that it is on account of lack of professional care and caution at his end in drafting the writ petition that the writ petition has been found out by this Court to be facts deficit.
3. Learned counsel for the petitioner seeks withdrawal of the writ petition with liberty to file fresh one with better factual particulars.
4. The present writ petition is dismissed as withdrawn with liberty to file fresh one bearing better and full pleadings.
5. The leave hereby granted to file fresh writ petition to last only for period of 30 days from the date of this order.
