JUSTICE GIRISH KATHPALIA O R D E R % 14.09.2026 Matter taken up today as the date of 11.09.2026 was declared a holiday on account of BRICS Summit vide Notification No. 86/G- 4/Genl.I/DHC dated 08.09.2026. 1. The accused/applicant seeks regular bail in case FIR No. 83/2023 of PS Mayapuri for offence under Section 420/467/468/471/472/120B IPC. 2. By way of order dated 24.04.2025, the earlier bail application was allowed to be withdrawn with liberty to file afresh upon receipt of FSL report. That FSL report is relevant to examine the allegation of forgery of the title deeds pertaining to the Green Park property. By the time this bail This is a digitally signed order. Be that as it may, during pendency of this application, FSL report is stated to have come but the same is not on record of this application. 3. In my view, the FSL report would be a change in circumstance, so the issue of bail must be first tested by the Court of Sessions. That being so, learned Senior Counsel for accused/applicant, on instructions, seeks permission to withdraw this application with liberty to file afresh before the Court of Sessions. 4. Accordingly, the regular bail application is dismissed as withdrawn with liberty as sought. At request of learned Senior Counsel, it is made clear that in the fresh application to be filed before the Court of Sessions, the accused/applicant shall be at liberty to raise the remaining grounds, if any, also. The matter is again taken up on mentioning by learned Senior Counsel for accused/applicant, submitting that the learned Court of Sessions has already dealt with the forensic report, so no purpose would be served by sending the accused/applicant back. 6. Since the earlier orders were passed in the bail applications of Dhankesh Yadav as well as of Ajit taking a view that there are certain common factual allegations against both of them, and since learned counsel for accused Ajit is not present, it would not be fair to hear on merits.
