1. Learned counsel for the petitioner submitted that vide judgment and order dated 21.07.2017 complaint petition filed by the petitioner being complaint case No. 372/2016 was dismissed under Section 204 (4) of Cr.P.C. for non-filing of the requisites, after passing of cognizance order against the O.P. No.2.
2. It is further submitted that the conducting counsel for the complainant was seriously ill and was hospitalized as to why she could not informed the petitioner for taking steps for filing requisites. Meanwhile, the complaint was dismissed.
3. There is no deliberate delay on the party of the petitioner. Hence, impugned order is fit to be set aside.
4. Learned A.P.P. appearing for the State has raised no objection in this regard.
5. In the facts and circumstances of the case, I find sufficient material to interfere with the impugned order, which is hereby set aside and this petition is allowed.
6. The complaint filed by the petitioner is hereby restored to its original number and the learned trial court is directed to proceed with the matter from the stage at which the complaint was dismissed.
