Neutral Citation No. - 2025:AHC:93372 Court No. - 9 Case :- MATTERS UNDER ARTICLE 227 No. - 5721 of 2025 Petitioner :- Smt. Afroz Respondent :- State of U.P. and Another Counsel for Petitioner :- Neeraj Agarwal,Syed Wajid Ali Counsel for Respondent :- C.S.C.,Shyam Mani Shukla Hon'ble Rohit Ranjan Agarwal,J. Heard Sri Syed Wajid Ali, learned counsel for the petitioner and learned Standing Counsel for respondent No.1. The name of Sri Shyam Mani Shukla, Advocate has been shown for respondent No.2 but he is not present in the Court. It is contended that eviction order was passed under the U.P. Public Premises (Eviction of Unauthorized Occupants) Act, 1972 against which the petitioner had preferred an Appeal No.5 of 2022 in which stay application was filed on 09.11.2021, which till date has not been decided. The sole prayer made in the writ petition is for expeditious disposal of the same. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit, with a request to District Judge, Bareilly to decide the stay application dated 09.11.2021 filed in Appeal No.5 of 2022 (Smt. Afroz vs. State of U.P. & Anr.), in accordance with law, after hearing all affected parties, preferably within a period of two weeks from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
