The petitioner No.1-Mohd. Maqbool Beigh is purported to be attorney holder of two brothers-Avatar Krishan and Chaman Lal, both Kashmiri Migrants in terms of an Irrevocable General Power of Attorney dated 16th of April, 2019 registered before the Court of learned Sub Registrar/ 3rd Additional Munsiff, Jammu in terms whereof the petitioner No.1 has been constituted to be attorney on behalf of the said two principals enabling the petitioner No.1 to deal on behalf of the principals with respect to the property forming the subject matter of the said Irrevocable General Power of Attorney. 02. However, the petitioner No.1 is coming forward along with the petitioner No.2, who is said to be a prospective vendee, to maintain the present writ petition for seeking the requisite directions unto the writ respondents. 03. Since the writ petition is not being maintained in the name of two principals of whom the petitioner No.1 is an attorney holder, as such, the writ petition cannot be entertained which is, thus, allowed to be withdrawn by the petitioners, in particular petitioner No.1 with liberty to file fresh one by reference to the names of the principals through whom the petitioner No.1 can come forward and maintain the present writ petition provided both the principals are alive so as to keep the attorney in reference intact. 04. Writ petition dismissed as withdrawn along with the connected CM, with the liberty granted as aforesaid.
