Heard Mr. T.K Deb, learned counsel appearing for the petitioner. Also heard Mr. P. Gautam, learned Sr. G.A. appearing for the respondents-State. [2]
This petition has been filed under Article 226 of the Constitution of India seeking the following reliefs:-
“i. ISSUE RULE, calling upon the Respondents to show cause as to why all records relating to the case of the Petitioner should not be transmitted to this Hon'ble Court; ii. ISSUE RULE, calling upon the Respondents and each one of them, to show cause as to why a Writ of Certiorari / Mandamus and/or in the nature thereof should not be passed for acquisition of the land of the petitioner s mentioned in schedule-B below or else to return back the land of the petitioner after restoring the land to its original shape with adequate compensation for damage of the land with interest @ 12% P.A w.e.f. 2005 till payment; iii. ISSUE RULE, calling upon the Respondents and each one of them, to show cause as to why a Writ of Certiorari/Mandamus and/or in the nature thereof should not be passed for immediate acquisition process;
iv. ISSUE RULE directing the Respondents to return back the land to the original owner i.e. the Petitioner in its original form; V. After hearing, be pleased to make the Rules absolute in terms of Prayer i. ii & iii above; vi. Any other relief(s) as to this Hon'ble High Court may deem fit and proper;”
[3] Mr. T.K. Deb, learned counsel submits before this Court that respondent-authorities have acquired the property of the petitioner without following acquisition proceeding and without paying any compensation. Since his property has been affected, in view of the road widening, he raised a demand for taking steps by way of demand notice dated 07. 10.2024. [4] Mr. P. Gautam, learned Sr. G.A. appearing for the respondents-State submits before this Court that the respondent- authorities have initiated the acquisition proceeding and would take some reasonable time to decide the matter. [5] In view of the submission made by the learned Sr.
G.A., since the matter is pending with the respondents-authorities, without expressing any opinion on the merits of the case, this writ petition is disposed of, directing the concerned respondents to take steps in accordance with law as expeditiously as possible. [6]
With the above observation and direction, this present writ petition stands disposed of. As a sequel, miscellaneous application(s), pending if any, shall stand closed. JUDGE
