JUSTICE C M JOSHI) Learned counsel appearing for the appellant submits that in pursuance of the decree passed in FDP No.23/2017, an appeal in R.A.No.5013/2021 was filed questioning the final decree drawn, which also came to be disposed of. It is submitted that the Execution Petition No.21/2021 filed for execution of the final decree has also been closed recording satisfaction of the decree. Therefore, it is submitted that the present appeal does not survive for consideration. Hence, the appeal stands disposed of as infructuous.
