This writ petition has been filed with the following prayer: "Issue a writ order or direction in the nature of mandamus commanding the respondent No.2 i.c. Additional Commissioner Judicial (1st) Varanasi Divisional Varanasi to decide the appeal/ case No.1536 of 2023 Computerized case No. C2023140000001536 (Lalta Prasad Vs. Ram Ajor) within stipulated period." It is contended that against the order passed under Section 41, an appeal has been preferred under Section 210 of the U.P. Land Revenue Act, 1901. The sole prayer made in the writ petition is to expedite the said appeal. As no useful purpose would be served in keeping the matter pending or issuing notice to the private respondent, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit, with a direction upon respondent no.2- Additional Commissioner Judicial (1st), Varanasi Division, Varanasi to decide Appeal/Case No.1536 of 2023 (Computerized Case No.C2023140000001536) filed under Section 210 of U.P. Land Rvenue Act, 1901, in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
