HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. BAIL APPLICATION No. - 18553 of 2025 Court No. - 70 HON'BLE SANTOSH RAI, J.
1. Heard learned counsel for the applicant, learned AGA for the State- respondents and perused the record. 2. This bail application has been moved on behalf of accused-applicant Aaditya Singh Alias Golu seeking enlargement on bail in Case Crime No.302 of 2025, under Sections 318(4), 338, 336(3), 340(2) B.N.S., Police Station- Kotwali, District- Ghazipur. 3. Learned counsel for the applicant submits that the accused-applicant has not committed any offence as alleged in the FIR. Applicant is languishing in jail since 7.5.2025. It is submitted that the character certificate has not been prepared by the applicant rather he has online applied for the issuance of character certificate. It is further submitted that the applicant is a student and is preparing for various competitive examinations. It is argued that the applicant has one criminal history to his credit in Case Crime No.148 of 2022, under Sections 147, 323, 336, 506 IPC in which he has already been acquitted by the competent court having jurisdiction in this regard. It is contended that charge-sheet has already been submitted, therefore, there is no reasonable possibility of intimidating or pressurizing the prosecution witnesses. It is further argued that the conclusion of trial will take sufficiently long and there is no likelihood of accused applicant fleeing from course of justice or tampering with evidence in case of release on bail. Hence, bail has been prayed for. 4. Learned AGA has vehemently opposed the prayer for grant of bail but could not dispute the aforesaid submission.
