LAKHIPUR DISTRICT- CACHAR ASSAM PIN- 78809 Advocate for the petitioner(s): Mr. I Alam Advocate for the respondent(s): Mr. SR Baruah, Govt. Advocate, Assam B E F O R E HON’BLE MR. JUSTICE DEVASHIS BARUAH ORDER Page No.# 3/4 16.09.2025 Heard Mr. I Alam, the learned counsel appearing on behalf of the petitioner. Mr. SR Baruah, the learned Government Advocate, Assam appears on behalf of the respondents. 2. The grievance of the petitioner is that while the appeal is pending against the suspension order, the respondent authorities are taking steps to de-tag the beneficiaries attached to the petitioner’s fair price shop to some other fair price shop. 3. Taking into account that in the meantime, the appeal has already been disposed of whereby the appeal of the petitioner has been dismissed, it is the opinion of this Court that any order passed in the present proceedings after the appeal of the petitioner had been dismissed would go against the public interest, inasmuch as, the beneficiaries would be affected on account of the continuation of the suspension of the petitioner’s fair price shop license. 4. At this stage, however, it is pertinent to mention that the petitioner has assailed the order passed by the Appellate Authority in WP(C)No.735/2025. 5. Under such circumstances, this Court is not inclined to entertain the present writ petition observing inter alia that depending on the reliefs so granted in WP(C) No.735/2025, appropriate orders would be passed if in the circumstance, the beneficiaries of the petitioner are de-tagged from the fair price shop. 6. The writ petition stands closed with the above direction. JUDGE Page No.# 4/4 Comparing Assistant
