1. The petitioners' application for grant of temporary injunction is pending before the trial Court. The petitioners have filed a suit for grant of decree of permanent injunction restraining the Gram Panchayat from dispossessing the plaintiff from the suit property measuring 200 acres.
2. The jurisdiction of the Civil Court is excluded. As per The Punjab Village Common Lands (Regulation) Act, 1961, the jurisdiction of the Civil Court to decide the question as to whether the property is shamlat deh or not, is excluded. Moreover, injunction application is yet to be decided by the Court.
3. Keeping in view the aforesaid facts, no ground is made out to issue directions.
4. Hence, the revision petition is dismissed. However, the petitioners, if so advised, may pray for decision of the application for injunction.
