JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 12-08-2025 Heard learned counsel for the petitioners and the State . 2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 191 ( 2 ), 190, 126 ( 2 ), 109, 351 ( 2 ), 352 and 351 (3) of the BNS. 3 . As per the prosecution case , on the alleged date and time of occurrence , due to dispute over possession of land, Patna High Court CR. MISC. No.52837 of 2025(2) dt.12-08-2025 2/3 maarpeet took place between both the parties in which it is alleged that these petitioners along with other co-accused persons assaulted informant and others, as a result of which they sustained injury out of which one Chandan Kumar sustained grievous injury who is alleged to have been caused by petitioner No. 1 Md. Jasmin and so far as, petitioner Nos. 2, 3 , 4, 5 and 6 are concerned, there is general and omnibus allegation of assault against them. Petitioners claim clean antecedent. Case and counter case . 4. Considering the fact that injury caused by petitioner No. 1 is grievous in nature , the prayer for pre – arrest bail of petitioner No. 2 is rejected. 5 . Considering the fact that allegation of assault is general and omnibus against petitioner Nos. 2, 3 and 4, clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner Nos. 2, 3 and 4, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Saharsa in connection with Sonbarsa P.S. Case No. 119 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Patna High Court CR. MISC.
