Heard the learned counsel for the parties. 2. This is an application filed by the petitioner praying for grant of anticipatory bail under Sections 482 & 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 apprehending her arrest for the offences punishable under Sections 406, 420, 467, 468, 471 and 120B of the Indian Penal Code, in connection with Manika P.S. Case No. 23 of 2010, G.R. No. 218 of 2010(s) pending in the Court of learned Additional Chief Judicial Magistrate, Latehar. 3. The learned APP opposes the prayer for anticipatory bail. 4. As per FIR, the petitioner was an Executive Engineer and at that point of time a fraud was committed in respect of digging of a pond under MGNREGA scheme. It is alleged that by showing photograph of an old pond and without there being any proper measurement, the government money has been defalcated. 5. During course of argument, the learned counsel for the petitioner submits that in this case charge sheet has already been submitted against the petitioner in the year 2019. 6. If charge sheet has already been submitted, there is no occasion for any investigation. Thus, this petitioner should appear before the learned Court below and, on his appearance, the Court below will pass an appropriate order ( 2025:JHHC:17701 ) 2 considering the fact that charge sheet has already been submitted in this case. 7.
