By means of this petition filed under Article 226 of the Constitution, even though petitioner has challenged the principal order passed by the competent authority on 23.01.2018 as well as the order passed by the appellate authority dated 06.10.2023 but he submits that the appellate authority has rejected the appeal for want of prosecution. He has filed recall application for restoration on 28.11.2023 which may be directed to be decided in accordance with law. 3. In such above view of the matter this petition stands disposed of with the direction to the respondent concerned/ appellate authority to dispose of the pending a Misc. Application for recall of the order dated 06.10.2023 as expeditiously as possible preferably within six weeks of the presentation of certified copy of this order. It is expected tat the appellate authority shall be taking pragmatic view of the matter in considering recall application.
