PUBLIC PROSECUTOR The Court made the following Order: The learned counsel for the petitioner submits that the petitioner is aggrieved by the order passed in Crl.M.P.No.1300 of 2024 in C.C.No.137 of 2024. It is submitted that the petitioner filed an application seeing permission of the Court for travelling to United States of America (USA). The petitioner also submitted the specific date of his travel and proposed date of return. The petitioner also sought direction to the passport authorities at Visakhapatnam to renew the passport for the above said purpose in the interest of justice. 2 2. The learned Magistrate has dismissed the application on the ground that the proposed date of travel and return had already expired. 3. The learned counsel for the petitioner submits that the petitioner intends to renew his passport and the prayer seeking renewal of passport and a direction to the passport authorities for renewal was not addressed by the learned Magistrate. 4. Considering the same, the order passed by the learned Magistrate is hereby set aside and the petitioner has to file fresh application seeking permission for renewal of his passport and on such application, the learned Magistrate shall pass necessary orders directing the authorities concerned to renew the passport of the petitioner. 5. With the above direction, the Criminal Petition is disposed of. There shall be no order as to costs. 6. As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition shall stand dismissed. ___________________ JUSTICE HARINATH.N BMS
