This is the third bail application filed by the applicant. The first bail application of the applicant is dismissed as withdrawn after arguing for some time vide order dated 25.06.2024 passed in MCRC No.3944 of 2024. While withdrawing the bail application, liberty was granted to the applicant to revive his prayer for bail after examination of the material witnesses. After examination of some the witnesses, the applicant has moved his second bail application vide MCRC No. 6645 of 2024 which was came up for VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2025.03.05 15:52:24 +0530 2 hearing before this Court on 26.09.2024 and the same was also dismissed on that very ground that some of the material witnesses are yet to be examined. 2. Thereafter, the present third bail application has been filed. 3. Learned counsel for the applicant would submit at the time when the second bail application was decided by this Court, the another eye-witness Mayank Kumar Sahu, was remained to be examined and now he has been examined before the learned trial Court and has not supported the prosecutions case. There is no allegation against the present applicant that he assaulted the victim by Thermocol cutter, he is in jail since 19.02.2024, final adjudication of the case will take its own time, therefore, he has filed his third bail application. 4. On the other hand, learned counsel for the State opposes. 5. Considering the submissions made by learned counsel for the parties, considering the nature of the allegation and material collected during the investigation further considering that the trial is in progress and till 03.12.2024 three witnesses have already been examined out of total 11 witnesses. There are other material witnesses which are yet to be examined and therefore, I am not inclined to admit this third bail application of the applicant. 6.
