Case No. 51/2024, arising out of Birni P.S. Case No. 90/2019, for the offence registered under sections 147, 148, 504, 506, 323, 324, 326, 307, 302, 120B of IPC but charges have been framed under sections 147, 148, 341/149, 342/149, 323/149, 324/149, 326/149, 307/149, 302/149, 504/149, 506/149, 120 (B) of the I.P.C., pending in the Court of learned Additional Sessions Judge-II, Giridih. Bail application of the petitioner was earlier rejected by a co-ordinate bench of this court vide B.A. No. 4526 of 2024 by order dated 09.09.2024. It is alleged that on 07.06.2019, the petitioner and the co- accused person, entered into the house of the informant and started assaulting her and her family members. It is further alleged that the petitioner had given a farsa blow on the head of the husband of the informant while Saddam Ansari assaulted him by an axe. The husband of the informant succumbed to his injuries. There is direct allegation against the petitioner of having assaulted the deceased.
