Heard learned counsel Mr. K. Das for the petitioner Biswajit Patgiri. Also heard Mr. D. P. Goswami, learned Additional Public Prosecutor for respondent State.
2. This is an application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying for grant of pre-arrest bail to the accused/petitioner in connection with Geetanagar P. S. Case No. 1/2025, under Sections 324 (5) and 326 (g) of BNS.
3. It is submitted by the learned counsel for the petitioner, Mr. Das, that the petitioner is innocent and is not at all involved in the alleged offence as stated in the FIR. A false and concocted allegation has been made against the petitioner, solely to harass his family, as his mother had lodged an FIR, which was registered as Geeta Nagar P.S. Case No. 450/2020, under Sections 341/325/34 of the IPC. He further submitted that, to date, no vehicle owner has brought any allegations against the petitioner, despite the FIR stating that he set fire to the vehicles, causing significant damage to both the vehicles and the temple. However, the FIR also mentions that the petitioner, along with some local person, extinguished the fire, effectively controlling the extent of the damage. He is ready and willing to co-operate with the Investigating Officer (IO).
4. I have scrutinized the case-diary. I have also considered the submissions at the bar. The petitioner has appeared before the Investigating Officer. He has cooperated with the investigation. He has not violated any bail conditions.
